Task force or study body Reported

No digital assets, blockchain or crypto task force, commission or study committee found. We searched: Searched nmlegis.gov and the web for New Mexico blockchain / digital asset / virtual currency task force, working group, study committee or memorial. Found only two 2020 legislative proposals (SB 113 creating a Blockchain Technology Task Force chaired by the Secretary of Information Technology, and SJM 9 asking the Secretary to convene one; both sponsored by Sen. Gerald Ortiz y Pino, report due 9/1/2021). The bill/memorial texts are primary sources; that both were postponed indefinitely (not enacted) comes only from a secondary law-firm summary (Freeman Law). No executive order, agency-created group or later statute found. This item had not received a full follow-up search at the time of review.

No active or concluded New Mexico task force found. Proposals only. Confidence is Reported because the failure of SB 113/SJM 9 is verified only via a secondary source. Bitcoin or digital asset reserve law Confirmed

SB 275 (2025, Sen. Anthony Thornton), the Strategic Bitcoin Reserve Act, would have let the State Investment Council and treasurer invest up to 5% of certain permanent funds in bitcoin and allowed retirement boards to use registered ETPs; the Senate Tax, Business and Transportation Committee tabled it in late February 2025 on a party-line vote, and the sponsor said he would reintroduce it. No 2026 reserve bill found (not exhaustively searched).

Licensing Unclear

New Mexico's Money Transmitters Act (Financial Institutions Division, Regulation and Licensing Dept.) does not expressly mention virtual currency; a secondary summary says the department's FAQ treats exchangers of virtual currency or other stored value as needing a money transmitter license, but says it remains unclear whether the law reaches cryptocurrency, and a 2019 bill (HB 649) to require a license for crypto exchanges was postponed indefinitely. No primary NM regulator page was read.

Crypto kiosks (ATMs) Reported

No New Mexico state crypto kiosk/ATM statute found. Locally, Albuquerque's Virtual Currency Ordinance (O-26-49, sponsor Councilor Stephanie Telles) bans crypto ATMs and cashier-assisted crypto sales city-wide; per a news report it passed the council Sept. 9, 2026, was signed Oct. 2, took effect Oct. 21, with removal due Dec. 5 and $500/day fines. This is a municipal measure, not state law.

Other 2025 to 2026 actions

  • 2026-09-09 to 2026-10-21: City of Albuquerque adopted and brought into effect a ban on crypto ATMs (local action; reported by secondary sources and local press, no city primary page read). The same council report cited NM crypto-fraud losses of $86.6 million in 2025.

Source notes: Reserve and kiosk findings do not include a full check of the 2026 NM session (30-day, budget-focused) on nmlegis.gov. Licensing entry rests on a secondary source of unknown date.
